General terms and conditions of sales

The following has been set out and agreed:
PREAMBLE
The Seller is a creator of resin and floral accessories and decorations, jewellery and key rings intended for consumers and marketed via its website (https://ohanacreas.com/fr). The list and description of the items offered by Les Créations D'Ohana can be consulted on the aforementioned site.
Article 1: Purpose
These General Terms and Conditions of Sale determine the rights and obligations of the parties in the context of the online sale of Products or Services offered by the Seller.
Article 2: General provisions
These General Terms and Conditions of Sale (GTCS) govern the sale of products through the Les Créations D'Ohana website and are an integral part of the Contract between the Buyer and the Seller. They are fully enforceable against the Buyer who has accepted them before placing an order.
The Vendor reserves the right to modify these Terms and Conditions at any time by publishing a new version on its website. The GTC applicable at that time are those in force on the date of payment (or of the first payment in the case of multiple payments) of the order.
Les Créations D'Ohana also ensures that their acceptance is clear and unreserved by putting in place a tick box and a validation click. The Customer declares that he/she has read all of these General Terms and Conditions of Sale and, where applicable, the Special Terms and Conditions of Sale relating to a product and accepts them without restriction or reservation.
The Customer declares that he/she is legally capable of entering into a contract under French law or that he/she validly represents the individual or legal entity on whose behalf he/she is entering into a contract.
In the absence of proof to the contrary, the information recorded by Les Créations D'Ohana constitutes proof of all transactions.
Article 3: Prices
The prices of products sold via the Website are indicated in Euros, inclusive of VAT, and are precisely determined on the Product description pages.
They are also indicated in euros including all taxes (VAT + any other taxes) on the product order page, and excluding specific shipping costs.
Article 4: Products
The essential characteristics of the products and their respective prices are made available to the purchaser on the company's website, as well as, where applicable, the method of use of the product.
In accordance with article L112-1 of the Consumer Code, the consumer is informed, by means of marking, labelling, display or any other appropriate process, of the prices and specific conditions of the sale and performance of the services before any conclusion of the sales contract.
In all cases, the total amount due by the Buyer is indicated on the order confirmation page. The sale price of the product is that in force on the day the order is placed, and does not include delivery charges invoiced in addition.
These costs, if any, are indicated to the Buyer during the sales process, and in any event when the order is confirmed. The Vendor reserves the right to modify its prices at any time, while guaranteeing the application of the price indicated at the time of the order.
Article 5: Delivery terms
Products are delivered to the delivery address indicated when the order was placed and within the times indicated.
These times do not take into account the time required to prepare the order.
Our delivery times are as follows:
3 to 5 working days for items in stock,
30 working days for customised orders.
Article 6: Payment
Payment is due immediately upon ordering, including for pre-ordered products.
We accept the following methods of payment:
- Credit card
- Paypal
- Bank transfer
Once payment has been initiated by the Customer, the transaction is immediately debited after verification of the information. In accordance with the provisions of the French Monetary and Financial Code, the commitment to pay by card is irrevocable.
By providing his/her bank details at the time of sale, the Customer authorises the Vendor to debit his/her card for the amount relating to the price indicated.
The Customer confirms that he/she is the legal holder of the card to be debited and that he/she is legally entitled to use it. In the event of an error, or of it being impossible to debit the card, the Sale is immediately cancelled and the order cancelled.
Article 7: Warranties
In accordance with the law, the Seller assumes the following guarantees: of conformity and relating to hidden product defects.
The Vendor shall refund the purchaser or exchange products that appear to be defective or do not correspond to the order placed.

Article 8: Complaints and mediation
If necessary, the Buyer may make any claim by contacting Les Créations D'Ohana by e-mail at this address: contact@ohanacreas.com.
Article 10: Force majeure
Performance of the seller's obligations hereunder shall be suspended in the event of the occurrence of a fortuitous event or force majeure which would prevent performance.
The seller will notify the customer of the occurrence of such an event as soon as possible.
Article 11: Protection of personal data
In accordance with Regulation 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, the Seller implements the processing of personal data for the purpose of selling and delivering the products defined in this contract
